General Terms

These Terms & Conditions replace and supersede any previously published Terms & Conditions

Carriage Paid; Any order over £300 excluding carriage and VAT will be delivered carriage paid by Mafana (UK mainland only, some post codes excluded), any order below this value will incur a delivery charge at the current rate, please refer to the website for current charges. For areas outside the UK mainland please request a courier quotation.

Minimum order; A minimum order value may be applied for first and subsequent orders. Cumulative order values may be taken into account when assessing continuing franchise relationships.

Contract; no order is binding until formally accepted by Mafana Ltd in writing. An order acknowledgement is not confirmation of a contract merely an intention to supply. A contract is binding once an order confirmation or invoice is issued by Mafana.

Settlement; You can pay by cheque or Electronic Funds Transfer (EFT or BACS). You may use a debit card or credit card however a credit card may incur a surcharge. Bounced cheques will be charged at £25 per cheque. Payments accepted on credit cards against order will be processed free of charge. Credit card payments to settle a credit account will be charged at 2%.

a)     Credit accounts; Credit accounts are created at Mafana’s discretion. Following an application for a credit account, you acknowledge Mafana may perform a credit check. Failure to adhere to the credit account terms may mean withdrawal of any credit facilities, at which time ALL outstanding sums become due for immediate settlement. Mafana Ltd reserve the right to charge interest at 8% pa above the Bank of England base rate on all overdue invoices on a daily basis until paid in full.

b)     Costs; the buyer is liable for any costs incurred in recovering unpaid sums.

c)     Invoice queries; any discrepancy or query on an invoice must be notified in writing within 7 working days of the invoice date, or the invoice will be deemed valid and Mafana Ltd will have no liability to investigate and rectify.

d)     Warranty; All goods are warranted against defects in materials and workmanship for 1 year, abnormal wear & tear excluded. Damage or abuse will not be considered for refund or replacement. Genuine warranty claims will be replaced with similar goods where available or a credit issued for the original amount at Mafana's discretion and only after agreed in writing by Mafana. No goods, faulty or otherwise should be returned without written authority or the issue of a GRN (Good Returns Number).

Refunds; generally goods will not be accepted back for credit. However, if goods are returned after pre-agreement, all carriage costs are for the account of the buyer and a re-stocking fee of 25% of the goods will be applied. All refunds must be notified in writing to Mafana within 3 working days of receipt of the goods. Items must be returned unworn in/with all original packaging. You will be advised of a GRN (Goods Return Number) before the goods can be returned.

Prices; trade prices are quoted net of VAT. Mafana Ltd uses its best endeavours to ensure accuracy in it publications but errors in prices will not be deemed misrepresentation nor binding. Prices are also subject to change without notice. Prices are only binding once an order is confirmed or invoiced.

Title; Mafana Ltd retains title to the goods until paid for in full. If the buyer has sold the goods to a third party it acknowledges it holds the proceeds of sale in trust for Mafana Ltd.

VAT; will be applied where appropriate at the prevailing rate to all goods, delivery and handling charges

Deposits; special orders or stock allocation orders may be accepted subject to payment of a deposit. Cancellation of such orders prior to delivery will forfeit any deposit due or paid.

Delay; Mafana Ltd cannot be held responsible for any delay in delivery however caused once an order has been accepted and despatched. Mafana Ltd will take all reasonable steps to track missing orders and replace goods lost prior to delivery

Damaged goods & shortages; all products leave Mafana Ltd in good condition. Any claim for goods damaged in transit or short shipped must be made in writing within 3 working days of receipt of the goods. Failure to make such a claim will be deemed acceptance of the order and associated invoice for payment.

Products; may vary from time to time due to continuous improvement and the application of quality control methods.

Representation; the images, colours & sizes are representative of the products delivered, which because of their nature cannot be guaranteed to be an exact representation of the product delivered or its published dimensions, which are provided only as a guide. Samples are only a representation of production and may be subject to minor changes.

Reproduction; due to limitations in printing and web displays, and the processes used in production Mafana Ltd cannot accept misrepresentations about colours that may appear different in the delivered product

Damages; Mafana Ltd will accept no claims for damages. Any claim that may arise for whatever reason will be limited to the invoiced value of the goods purchased

Exclusivity; no exclusive distribution, sale or other rights accrue to a purchaser of Mafana products. To maintain an orderly market and provide good retail coverage for the end-consumer, where possible and subject to EU law, Mafana will refuse to supply a retailer if Mafana products are already sold by an approved Mafana stockist in close proximity. Close proximity is defined as 5 miles in a large town or city or 10 miles in a village or small town. This definition is provided for guidance only and the Company may appoint any number of approved stockists in a geographic area. The decision to approve a Mafana stockist is at the sole discretion of the Company and its decision is final. Approval may be withdrawn at any time and Mafana Ltd will not be required to provide reasons for so doing.

Law; any dispute is subject to the law in England & Wales and the jurisdiction of the English courts

Franchise; The buyer acknowledges the market position and value of the brands and will not do anything to bring the brands into disrepute. Predatory pricing, sale of Mafana brands on eBay or Amazon (or similar auction or discount sites) will be deemed to bring the brand(s) into disrepute and Mafana can ask the buyer to desist from such action and may refuse to supply further goods.
